Walau bagaimanapun, sekiranya syarikat tersebut hendak mengimport, mengeksport atau meletakkan peranti perubatan dalam pasaran, syarikat tersebut perlu mempunyai lesen yang sah dan peranti perubatan tersebut perlu berdaftar terlebih dahulu selaras dengan peruntukan dalam Seksyen 5 dan Seksyen 15, Akta 737.
